Terms of service

Last updated: October 6, 2026

Overview

Welcome to From Me, Always. The terms “we,” “us” and “our” refer to BARK AND OLIVE LLC, operating as From Me, Always. Our contact information is in Section 25. We operate this store and website, including its content, features, tools, products and services (the “Services”). From Me, Always is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with the policies linked below, describe your rights and responsibilities when using the Services. Please read them carefully. By using the Services, you agree to these Terms. Our Privacy Policy (https://frommealways.com/policies/privacy-policy) explains how personal information is handled. If you do not agree to these Terms, please do not use the Services.

Our Refund Policy (https://frommealways.com/policies/refund-policy) and Shipping Policy (https://frommealways.com/policies/shipping-policy) form part of these Terms. Their specific promises about refunds, cancellations, delivery problems and shipping apply if a general statement in these Terms conflicts with them. Nothing in these Terms, including any disclaimer, release or limitation, removes rights or remedies that applicable law does not allow us to exclude.

1. Access and account

To place an order, you must be legally able to enter into a binding contract, or have a parent or guardian who is legally able to do so place the order for you. You must provide accurate, current and complete contact, delivery and payment information and be authorized to use the payment method you supply.

Please keep your account credentials and sign-in codes secure and notify us if you suspect unauthorized use. You may not sell, transfer or license your account to another person. Your responsibility for unauthorized transactions is subject to applicable law and the rules of your payment provider.

2. Our products

We aim to describe and depict our products accurately. Some images are supplier-generated digital previews; screen settings, lighting and normal production variations can affect appearance. These differences do not excuse supplying a materially different, faulty, damaged, incorrect or incomplete product. Contact us about a problem under our Refund Policy (https://frommealways.com/policies/refund-policy).

Read the selected product, finish and box description before ordering. Our current message-card designs have fixed wording, including the printed sign-off; they are not buyer-personalized. A gold-finish description does not mean that the necklace is solid gold. The product listing describes the included necklace, message card and packaging.

We may change descriptions, availability and the range offered for future purchases. These changes do not retroactively change the product or price in an accepted order. We may apply reasonable quantity and delivery-area limits, as shown before purchase.

3. Orders, cancellations and refunds

Submitting an order is an offer to purchase. We confirm accepted orders by email after payment is processed. We may decline an order for a legitimate reason, such as product unavailability, a payment problem, suspected fraud or an address outside our delivery area. If we cannot accept or fulfill an order, we will notify you using the contact details you supplied and promptly refund any payment for the canceled items, including applicable tax and shipping.

Please review your order before submitting it. Email cancellation or change requests promptly to support@frommealways.com. Production moves quickly; once it begins, we may be unable to stop or change it. We will confirm what is possible. This does not limit cancellation or refund rights arising from shipment delays, order problems or applicable law.

Returns and refunds follow our Refund Policy (https://frommealways.com/policies/refund-policy), including the offer to contact us within 30 days after delivery, its condition requirements and its exceptions for faulty, incorrect or undelivered goods. We do not offer direct exchanges. Approved refunds go to the purchaser’s original payment method; gift recipients may contact us for help.

Our store is intended for personal and household purchases, including gifts. Contact us before placing an order for commercial resale.

4. Prices and billing

Prices are displayed in US dollars unless expressly stated otherwise. The product price and any discount, tax or delivery charge are shown before you submit the order. Standard shipping is currently free to our supported delivery area with no minimum spend. We do not add an undisclosed handling fee after checkout.

We may change prices or promotions for future orders. A later change does not alter the agreed price of an accepted order. Separate promotion terms apply only to the promotion they describe and do not remove mandatory consumer rights.

You must provide accurate billing information and be authorized to use the payment method provided. You authorize the amount presented at checkout. If an error affects an order, we will follow Section 12 rather than charging a higher price without your agreement.

5. Shipping and delivery

Our Shipping Policy (https://frommealways.com/policies/shipping-policy) describes delivery coverage and estimates. At launch, we offer free standard shipping to street addresses and PO boxes in all 50 United States and Washington, DC, including Alaska and Hawaii. Military addresses, US territories and international destinations are not included.

Allow an estimated 3–5 business days for preparation, followed by an estimated 2–5 business days for delivery in the contiguous 48 states and Washington, DC. Alaska and Hawaii may take longer. Business days exclude weekends and holidays. Arrival on a particular date is not guaranteed. We email tracking when available, and items may arrive separately.

If we cannot ship on time, we will provide a revised shipping date and the option to cancel unshipped items for a prompt refund. We will obtain any required agreement to a delay; without it, we will cancel and refund the affected unshipped items. We will not charge additional shipping costs without your agreement.

Contact us if a package is delayed, missing or damaged, including when tracking says delivered but you have not received it. We will investigate and provide help, including a replacement or refund where appropriate under our policies or applicable law. Handing a parcel to a carrier does not end these obligations.

6. Intellectual property

The text, designs, images, logos and other materials in the Services belong to From Me, Always or their respective owners and licensors. You may view and use the Services for personal shopping, keep copies of your order records and these Terms, and make other uses allowed by law.

You may not copy or commercially exploit protected material without permission or another legal basis. Our name and logo identify From Me, Always. Shopify’s name and logo belong to Shopify; other third-party names and materials belong to their respective owners. No rights to third-party materials are granted beyond the rights their owners permit.

7. Optional tools

The Services may offer optional third-party tools. These tools may have their own terms and privacy notices; review those notices before using them. We do not control independently operated tools and do not guarantee their uninterrupted availability. This does not remove our responsibility for our own conduct, purchases made from our store, or rights that applicable law protects.

New features we introduce are subject to these Terms unless specific terms are clearly provided for them.

8. Third-party links

Links to independent websites may take you outside our Services. We do not control those websites; review their terms and policies before using them or buying from them. A link does not by itself mean that we endorse the website. Our use of a supplier or payment provider to fulfill an order from our store does not transfer our customer-service responsibilities to you.

9. Relationship with Shopify

From Me, Always is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with From Me, Always. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and From Me, Always, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with From Me, Always.

10. Privacy

Our collection and use of personal information are described in our Privacy Policy (https://frommealways.com/policies/privacy-policy). Certain processing by Shopify is also described in Shopify’s Privacy Policy (https://www.shopify.com/legal/privacy).

Shopify hosts the Services and processes information to provide and improve them. Information may be shared with Shopify and service providers in countries other than your country of residence, as described in those privacy notices. Read them for details about processing and your privacy choices.

11. Feedback and reviews

If you voluntarily submit a review or other content for public display on our Services, you give us a non-exclusive, worldwide, royalty-free license to display and reproduce that submission in connection with our store and products. You retain ownership of your content. We will not change its meaning or use it to misrepresent your experience. Any use of personal information remains subject to our Privacy Policy and applicable law.

Please submit only content you are authorized to share and disclose any incentive or material connection relevant to a review. Do not impersonate someone, submit fabricated reviews, infringe rights or include unlawful threats, malware or another person’s private information.

We may moderate submissions for these reasons, but we do not prohibit honest negative reviews or require you to give up the right to share an honest experience. Private support messages are not treated as permission to publish a testimonial. We are not required to pay for or implement voluntarily submitted ideas unless we separately agree.

12. Errors, inaccuracies and omissions

We may correct errors in product descriptions, prices, availability or other information. If a material error affects your order, we will contact you to explain it. We will not substitute a materially different product, increase the agreed price or impose a material change without your agreement.

If an order cannot be fulfilled as agreed and you do not agree to an offered correction, we will cancel the affected items and promptly refund their payment, including applicable tax and shipping. This does not limit any additional rights or remedies under applicable law.

13. Prohibited uses

Use the Services lawfully. You must not commit fraud, impersonate another person, infringe intellectual property or privacy rights, harass others, publish unlawful content, send spam through our systems, distribute malware, misuse payment information, or attempt unauthorized access to accounts or systems.

You must not disrupt the Services, collect others’ personal information without authority, circumvent access controls, or use scraping or other automation contrary to our authorization and published access rules. Ordinary browsing, accessibility tools, permitted search-engine indexing, and integrations or shopping agents expressly authorized by us or made available through our supported channels are not prohibited merely because they use software or automation. Agents are also subject to Section 14, where applicable.

We may restrict access where reasonably necessary to address fraud, security risks, unlawful conduct or a material breach of these Terms. A restriction does not cancel rights to refunds or other remedies for existing purchases.

14. Agents and automated access

These provisions apply to software that takes autonomous or semi-autonomous actions on a customer’s behalf when interacting with the Services. An agent must have appropriate authority from that customer and use a supported channel or other access we permit. The customer remains responsible for the instructions and purchasing authority they give an agent, subject to applicable law.

Agents must identify themselves honestly through their customary user-agent information or the identification and authentication mechanisms required by the interface they use. They must not pretend to be human, give false answers about their automated nature, complete or circumvent challenges intended to distinguish humans from automated tools, bypass access controls, evade rate limits or continue after access is refused. Agents must follow the applicable interface requirements and any limitations we communicate.

We may limit or withdraw automated access for security, reliability or misuse. Search-engine indexing allowed by our published crawl rules and business integrations operating under a separate authorization are governed by those rules or authorizations. Nothing here grants access beyond that authorization, authorizes purchases or checkout methods outside the separately granted scope, or overrides a provider’s requirements.

15. Termination

You may stop using the Services at any time. We may suspend or terminate access for the reasons described in Section 13 or if the Services are discontinued, providing notice when reasonably possible and required by law.

Termination does not remove payment obligations validly incurred, our obligations for accepted orders, privacy rights, or refund and other consumer remedies. Provisions about intellectual property, submitted public content, unresolved obligations, applicable law and other provisions that need to operate after termination continue to apply to that extent.

16. Service availability and product rights

We aim to keep the website accurate and available, but maintenance, technical faults or interruptions can occur. We do not promise that online tools will always be uninterrupted or error-free.

These statements about website availability do not disclaim product descriptions, express promises, refund or shipping obligations, statutory warranties, or remedies available under applicable law. Products are not made final sale or sold without legal protections merely by your use of this website.

17. Liability and consumer protections

Our responsibility, and any remedy available to you, are governed by applicable law and the commitments in these Terms and our policies. No provision limits liability that cannot lawfully be limited, including liability for fraud, intentional misconduct or other protected claims.

Nothing in these Terms excludes claims for faulty, damaged, misdescribed, incorrect or undelivered goods, removes an applicable product warranty or refund right, or requires a consumer to waive a remedy the law protects. We do not impose a blanket exclusion of direct losses or personal-injury claims through these Terms.

18. Responsibility for misuse

You are responsible to the extent provided by law for harm caused by your fraud, intentional unlawful misuse of the Services or infringement of another person’s rights. Ordinary lawful use of the store does not create an obligation to indemnify us or Shopify. This section does not make you responsible for our conduct or require you to give up a consumer protection.

19. Severability

If a provision of these Terms is held unlawful or unenforceable, it will not be enforced to that extent. The remaining provisions continue to apply where they can lawfully operate independently.

20. Waiver and agreement

Not enforcing a provision on one occasion does not waive the right to enforce it later. These Terms, the linked policies and the specific terms agreed at purchase describe our agreement about use of the Services and your order. Nothing here removes rights arising from product descriptions, advertisements, express promises or applicable law.

21. Assignment

You may not transfer your account or contractual obligations without our agreement. This does not prevent buying or giving a product as a gift. We may transfer the operation of the business and related contractual rights and obligations, provided that this does not reduce your existing consumer rights. We will give any notice required by law.

22. Governing law

These Terms and disputes concerning the Services are governed by the law applicable to the transaction. Mandatory consumer protections apply regardless of any other provision in these Terms. These Terms do not require arbitration, waive access to small-claims court or impose an exclusive court location.

23. Headings

Headings help you find information and do not change the meaning of these Terms.

24. Changes to these Terms

The current Terms are available on this page with their update date. We may revise them for future use of the Services and will provide notice of material changes as required by law. Changes will not retroactively reduce rights or alter the agreed terms of an existing order without your agreement where required. Any required acceptance of revised terms will be obtained through an appropriate process.
